โ ๏ธ Release of Liability & Assumption of Risk
In consideration of being permitted to use the facilities, amenities, services, and beach equipment provided by Waikiki Beachside Hostel ("the Hostel"), I voluntarily agree to the following:
1. Assumption of Risk โ Ocean & Beach Activities
I acknowledge that ocean activities and use of beach equipment involve inherent and potentially fatal risks including drowning, injury from waves or rip currents, marine life encounters, sunstroke, and equipment failure. I voluntarily assume ALL such risks, whether or not caused by the Hostel's negligence.
2. Release of Liability
To the fullest extent permitted by law, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Waikiki Beachside Hostel, its owners, managers, employees, and agents from any and all liability for any loss, damage, personal injury, or DEATH โ whether caused by negligence or otherwise โ while on the premises or using any hostel equipment or facilities.
3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, cost, or expense resulting from my actions, use of the premises, use of equipment, or breach of any rule.
4. Medical Authorization & Financial Responsibility
In an emergency, I authorize the Hostel to seek medical assistance on my behalf. I accept full financial responsibility for any medical treatment or transport costs incurred.
5. Property & Belongings
I accept responsibility for any damage I cause to Hostel property. I acknowledge the Hostel is not liable for lost, stolen, or damaged personal belongings.
6. Travelers-Only Acknowledgment
I confirm that I am a bona fide traveler visiting Oahu and am not a current Hawaii resident. I understand that Waikiki Beachside Hostel is exclusively for visitors to the island, and I am able to provide proof of outbound travel upon request. Misrepresentation of my residency status voids this agreement and my reservation with no refund.
7. Binding Agreement
I am 18 years of age or older, have read and fully understood this document, am signing freely without duress, and this agreement is binding upon my heirs, assigns, and legal representatives.
8. Off-Property Activities & Recreational Risks
I acknowledge that activities occurring outside the Hostel property involve inherent risks. Participation is entirely voluntary and undertaken at my own risk. Waikiki Beachside Hostel is not responsible for any injury, loss, damage, or death occurring during activities outside the property.
9. Third-Party Vendors & Tour Operators
The Hostel assumes no responsibility for the actions, safety practices, or services provided by third-party tours, rentals, transportation providers, or activity operators.
10. Personal Conduct & Alcohol Responsibility
I accept full responsibility for my own actions, behavior, and decisions during my stay. Waikiki Beachside Hostel shall not be liable for any injury, loss, or damage resulting from my conduct.
11. Housekeeping Access
I agree that housekeeping access is required at least once every 48 hours. Dorm rooms are subject to mandatory daily cleaning and may not decline access.
12. Personal Belongings
I acknowledge I am responsible for properly storing and securing my personal belongings. The Hostel is not responsible for any lost, stolen, misplaced, or damaged items.
13. Social Media & Media Release
I grant Waikiki Beachside Hostel permission to use photos or recordings taken during my stay for promotional purposes. If I do not wish to appear, it is my responsibility to notify staff in advance.
14. Governing Law & Jurisdiction
This agreement is governed by the laws of the State of Hawaii. Any disputes shall be resolved exclusively in the courts of Honolulu County, Hawaii.
